Tax system of S. Dakota

Income Tax

One of South Dakota's main advantages is that there is no personal income tax at all.

Sales Tax

South Dakota's base sales tax rate is 4.2% (down from 4.5% in 2023). A local municipal tax is added on top, bringing the total rate up to 6.5% depending on the jurisdiction. Sales tax applies to many goods and services, including digital products, rentals, cloud services, and professional services. Determining the taxable base and the applicable sales tax rate can be quite complex and requires a professional approach and knowledge of state law. Our firm provides services for obtaining a Sales Tax Certificate, as well as for preparing and filing the Sales and Use Tax Return. We advise business owners on matters related to this tax, including registration, calculation, and reporting.

Property Tax

In South Dakota, property tax is levied at the county level. The average effective rate is about 1.22% of a property's market value.

Business Taxes

South Dakota does not levy a Corporate Income Tax or a Franchise Tax. It is one of the few U.S. states with zero corporate tax, which makes it especially favorable for registering holdings, trusts, and financial and online companies. An Annual Report is required for all registered companies (LLCs, corporations, and other legal entities). It is due annually by the first reporting month of registration. Our firm provides services for preparing and filing the Annual Report, registering new companies, choosing a structure (LLC, S-corp), setting up tax reporting, and maintaining bookkeeping in accordance with South Dakota law.

Excise Taxes

South Dakota levies excise taxes on fuel, tobacco products, alcohol, and certain commercial transactions, including mobile communications and car rentals.

Favorable Tax Conditions

South Dakota is considered one of the most tax-favorable states in the U.S. thanks to: • The complete absence of personal income tax and corporate tax for companies; • A low base sales tax rate; • No estate or gift tax; • A simple tax structure; • An asset and trust protection program that makes the state popular for registering trust structures.

Compared to Other States

No personal income tax at the state level — as in Florida, Texas, Nevada, and Wyoming; no Corporate Income Tax or Franchise Tax, unlike most states; sales tax is lower than in a number of states with high local surcharges; there is an obligation to file an Annual Report, but no minimum business tax; no estate tax — an important advantage when transferring property.
