US tax obligations while living in Spain
Spain offers Mediterranean lifestyle, lower cost of living than Portugal in many areas, and the Beckham Law for qualifying employees. The 2023 Digital Nomad Visa created a fast track for remote workers and freelancers. Healthcare is universal and ranks among the world's best.
TL;DR
Where Americans live in Spain
Spain hosts an approximately 40,000+ US expat population. The community concentrates in several cities with established expat infrastructure — international schools, English-speaking medical providers, American-style amenities, and active social communities. Below are the primary destinations.
Spain's local tax — what you need to know
Spain has progressive PIT up to 47% (regional, can hit 49% in some autonomous communities). The Beckham Law (Régimen Especial para Trabajadores Desplazados) allows qualifying employees and certain entrepreneurs to be taxed at a flat 24% on Spanish-source income up to €600,000 for six years, with no taxation on foreign-source income other than Spanish-source.
Special tax regime details
Beckham Law (Régimen Especial) — flat 24% on Spanish-source income up to €600,000 for 6 years, exemption from wealth tax on foreign assets, no requirement to declare foreign assets on Modelo 720 during the regime period.
✓ US-Spain Income Tax Treaty in force (signed 1990 (amended 2019))
The treaty allocates taxing rights between the US and Spain, allows Foreign Tax Credit for {country} taxes paid against US tax on the same income, and reduces withholding rates on cross-border payments (dividends, interest, royalties). The Saving Clause preserves US right to tax its citizens regardless of treaty, but most operative provisions still apply for credit / sourcing purposes. The treaty significantly simplifies double-taxation planning compared to no-treaty countries.
Social Security totalization agreement
The US has a Totalization Agreement with Spain, which means self-employed Americans living in {country} do NOT pay US Self-Employment Tax (15.3%) on income already subject to {country}'s social security system. This is a substantial saving — without totalization, self-employed expats pay both US SE Tax AND foreign social security on the same earnings.
Residency and visa pathways to Spain
Digital Nomad Visa (since 2023, requires €2,762/month income), Non-Lucrative Visa (passive income), Entrepreneur Visa, Golden Visa (real-estate route ended April 2025)
Banking and FATCA notes for Spain
Spanish banks (BBVA, Santander, CaixaBank, Sabadell) open accounts for US citizens with NIE. FATCA reporting standard. Modelo 720 (declaration of foreign assets >€50,000 per category) is a separate obligation from US FBAR and 8938.
